Terms of service

Please read these terms of service carefully. They contain important information that affects your rights, remedies, and obligations. They include an agreement to arbitrate (unless you opt out). These terms also include a prohibition of class and representative actions and non-individualized relief for all matters in either court or arbitration, various limitations and exclusions, a clause that governs the jurisdiction, venue, and governing law of disputes, except where prohibited, and obligations to comply with applicable laws and regulations.

Introduction

Opulence Corporation Inc. (“Seifly”, “we”, or “us”) runs the Seifly platform: a car sharing marketplace that connects people who own vehicles with people who need to book them, on-demand rides, and package delivery. The platform is available at seifly.app, rental.seifly.app, host.seifly.app, and through the Seifly Rider, Seifly Driver, and other Seifly apps. We call the websites, apps, and related services together the “Services”. By using the Services, including by messaging us or another Seifly user, you agree to be legally bound by these Terms of Service (“Terms”), whether or not you have registered an account. These Terms are a binding agreement between you and Seifly.

These Terms, together with our cancellation policy, nondiscrimination policy, community guidelines, additional policies, privacy policy, the terms of any protection plan you choose, and every other policy linked from them (together, the “Policies”), make up the “Agreement” between you and Seifly. For car rentals, Seifly acts only as the intermediary between the renter who books a vehicle (“renter”) and the owner who lists it (“host”). For rides and deliveries, Seifly connects the person who asks for a service (“rider” or “sender”) with the independent driver who provides it (“driver”). Each booking also produces a trip summary in your account that records what the host and renter agreed to, and you may use it as proof of your reservation.

Modification

We may change the Services or this Agreement at any time. When we change these Terms we will post the new version here and update the “Last revised” date at the top. If you keep using the Services after a change is posted or notified to you, you accept the changed Terms. If you do not accept them, your only option is to stop using the Services and close your account within 30 days. If you close your account within that period, the previous version of the Terms will keep applying to you unless you used the Services during those 30 days, in which case the new version applies.

The Seifly services

Seifly is one platform with one account. Depending on where you are and what you choose to do, the Services include:

  • Seifly Rentals, a marketplace where hosts list vehicles and renters book them, at rental.seifly.app and host.seifly.app and in the related apps.
  • Seifly Rides, on-demand rides that riders request in the Seifly Rider app and that independent drivers provide through the Seifly Driver app.
  • Seifly Delivery, package delivery that senders request and that drivers carry out.
  • The account, sign-in, wallet, vouchers, gift cards, referrals, notifications, support, and business tools that go with them.

Which terms apply to you

Every section of these Terms that is not marked as specific applies to everyone who uses any part of the Services. The sections called “Specific terms for renters”, “Specific terms for hosts”, “Specific terms for riders”, “Specific terms for drivers”, and “Specific terms for deliveries” apply on top of them to the people and the services they name. If a specific section conflicts with a general one, the specific section wins for that service. You may use more than one part of the Services with the same account, and in that case each part’s terms apply to that use.

Seifly’s role

Seifly is a technology company. Unless a page or a written agreement says otherwise, Seifly does not itself rent vehicles, drive riders, or carry packages. Hosts, drivers, and the other people who provide those services do so on their own account and are responsible for what they do. Seifly provides the platform, the payment and payout tools, the safety and support tools, and the matching of people who want a service with people who provide it.

Eligibility, registration, verification

Eligibility

You must be at least 18 to create a Seifly account, except that a parent or legal guardian may add a person under 18 to a family account for Seifly Rides as described in the terms for riders. To book a vehicle you must be at least 21 and hold a valid, unexpired driver’s license that is accepted in the location of the vehicle. Hosts and drivers must also be at least 21. Anyone who does not meet these requirements may not use the Services.

Registration

To use certain features you need a Seifly account. You can create one with your name, email address, and mobile phone number, which we verify with a one-time code. When you book a vehicle you give us more details about yourself, and when you list a vehicle you give us details about yourself and the vehicle. Everything you provide must be accurate, current, and complete, and you must keep your account up to date. Depending on what you tell us, we may add requirements before a trip can start, such as a security deposit, a payment-method authorization, a second form of payment, or the purchase of a protection plan.

Verification

Where the law allows, Seifly may, but is not obliged to, run screenings and checks that help confirm who users are, review their driving history and driver’s license, and verify vehicle details. These can include a government-issued photo ID, a selfie or liveness check, license validation, and, where permitted by law, a review of driving and criminal records, carried out by Seifly or by third-party verification providers. You authorize us to request, receive, use, and store that information, and you agree to be re-verified from time to time. We do not endorse any vehicle, user, or user background, and we do not promise any particular screening process. We may accept or refuse any request to book or list a vehicle in our sole discretion.

Seifly may try to promote vehicle safety, but we do not state or confirm that any vehicle on the Services is safe, roadworthy, or legally registered. That responsibility belongs entirely to the host. A host must make sure the vehicle is in safe and operable condition, legally registered for public roads, has a clean title (not salvage, branded, washed, or written off), has no open safety recall, and otherwise meets our vehicle requirements.

Consumer report authorization

When you try to book or list a vehicle, or at any later time when we reasonably believe your account carries more risk than usual, you give Seifly written instructions to obtain your auto insurance score, credit report, or a background check, including a criminal background check where the law allows, in line with the Fair Credit Reporting Act and similar consumer reporting laws.

Fees, taxes

Fees

The price of a trip, our service fee, and any other charges are itemized at checkout, so you can check the total before you send a trip request. Hosts can see their earnings in the host dashboard. When you give us a payment method you authorize Seifly and our payment processor, Stripe, to store it and charge it for amounts you owe, including trip costs, deposits, late fees, tolls and other incidentals, claim costs, and related administrative fees. A card authorization may be placed around the start of a trip to cover a deductible, tolls, or incidentals. If we try to refund you and the original payment method is no longer available, we may give you travel credit instead. Promotional credits, referral credits, and vouchers follow their own terms and have no cash value except where the law requires.

Collection of fees

We and our service providers will use all lawful means to collect money you owe, including collection agencies and legal counsel. Late or missed payments may be reported to credit bureaus, and accounts in default or with chargebacks may be charged the costs of collection. To dispute information that Seifly reported, contact us at support@seifly.app. To dispute something a collection agency reported, contact that agency directly.

Taxes

Where required, Seifly may collect and remit taxes on behalf of renters and hosts. Any such taxes appear as separate lines on your trip documents. Where Seifly collects a tax, the host may not collect the same tax again. Hosts are responsible for their own income taxes and must keep their tax details current. We may be required to report hosts’ gross earnings to tax authorities, and you consent to receive tax documents from us electronically.

Your commitments

You agree to use your account and the Services in line with these Terms, the law, and any other standards we give you.

Account activity

You are solely responsible for everything that happens through your account. Keep your sign-in details secure, never share the one-time codes we send you, and tell us right away if you suspect someone else has used your account. We are not responsible for losses that come from your failing to do so, or for any delay in securing your account unless you reported the unauthorized access to us.

Content

Seifly content and user content license

If you follow these Terms, Seifly gives you a limited, revocable, non-exclusive, non-transferable license to view the Seifly content and user content you are allowed to see, for personal, non-commercial use only. You may not sublicense it, and nothing in these Terms gives you any other right in Seifly’s or its licensors’ intellectual property.

User content

We may let you post photos of yourself and your vehicle, reviews, feedback, and descriptions. When you make content available through the Services, you give Seifly a worldwide, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, display, distribute, and otherwise use that content to operate, promote, and market the Services. You keep ownership of your content, and you promise that you have the rights needed to give us this license and that your content does not infringe anyone else’s rights.

Copyright protection

We respond to notices of alleged copyright infringement, and we close the accounts of repeat infringers, as described in our copyright policy.

Third-party services

Parts of the Services use third-party services such as mapping, address search, bot protection, and payment processing. When you use those parts you are also bound by the terms of those providers.

Prohibited activities

When you use the Services, you agree not to do any of the following, and not to encourage, request, or help anyone else to do them.

Break the law

  • Violate or get around any local, state, or national law, court order, airport rule, tax rule, licensing or registration requirement, or third-party right.
  • Post content that is false, misleading, or defamatory.
  • Copy, reverse engineer, or create works from content that belongs to Seifly or to another user or third party, without permission.
  • Use the Seifly name or something confusingly similar in a domain name, business name, social media handle, or advertisement in a way that harms the Seifly brand.

Give false or misleading information

  • Provide a false name, date of birth, driver’s license detail, payment method, insurance detail, or other personal information, or register an account for someone other than yourself or the company you represent.
  • Impersonate any person or company, or misstate your connection to one.
  • Make a false or misleading statement in a claim, for example about damage to a vehicle.

Fail to honor your commitments

  • Fail to pay fees, penalties, or other amounts owed to Seifly or another user.
  • Fail, as a host or a renter and without a good reason, to deliver, make available, or return a vehicle or an add-on on time.
  • Use Seifly to find a host or renter and then complete the booking, in whole or in part, outside the Services to avoid fees or protections.
  • Transfer your account to someone else without our consent.
  • Leave a vehicle unlocked, or running with the keys inside.

Harm or threaten other users

  • Harass, stalk, threaten, or abuse another user, or collect or store another user’s personal information for any purpose other than completing a booking.
  • Share another person’s photo, contact details, payment details, or account numbers without their permission.
  • Treat anyone differently because of who they are. Discrimination of any kind is not allowed in the Seifly community. See our nondiscrimination policy.
  • Bring legal claims against Seifly or another user in a way these Terms prohibit or waive.

Use the Services for unrelated purposes

  • Contact another user for any reason other than a booking, vehicle, listing, or use of the Services.
  • Sell or otherwise commercialize content or software from the Services, including reviews.
  • Collect information about users without consent, including by running background checks on them.
  • Recruit users to a competing service without our written approval.

Interfere with the Services

  • Interfere with another user’s listing, or send spam through the Services.
  • Spread viruses or other harmful code, launch denial-of-service attacks, or otherwise disrupt or overload the Services.
  • Scrape, crawl, or systematically collect data from the Services, or frame or mirror any part of them.
  • Access or tamper with non-public areas of our systems, probe or test their security, or bypass any protection measure.
  • Decompile, disassemble, or reverse engineer our software.
  • Get around a suspension or closure by opening a new account or by listing vehicles tied to a suspended or closed account.

Specific terms for renters

The following also applies if you book a vehicle on Seifly.

Renter commitments

You promise that you are a legally licensed driver and that you will show a current, valid driver’s license when asked. You will treat the vehicle and any add-ons with care and take all reasonable steps to return them on time and in essentially the same condition as you received them, including a similar fuel or charge level unless you and the host agreed otherwise. Only people added to the trip through Seifly as approved drivers may drive the vehicle.

Financial responsibility for damage to the vehicle

The renter who booked the trip (the “primary renter”) is financially responsible for damage to, or theft of, the vehicle during the trip, plus any extra costs and fees that result from damage of any kind, regardless of who was at fault. This applies whether or not the primary renter has their own auto insurance. Your own auto policy may cover damage to the vehicle you booked, and you agree to work with Seifly to make a claim under any policy that applies. A protection plan can limit what the primary renter has to pay out of pocket, but only if the primary renter and every approved driver follow these Terms, and only for physical damage that is not mechanical or interior damage. If you misuse a vehicle you will be fully responsible for any related claim, loss, or damage, and your protection plan may be void.

Liability insurance

Hosts cannot offer you liability insurance. Where a trip includes baseline liability coverage, its terms, limits, and exclusions are described at checkout and in the coverage documents. If you have your own personal auto policy, it may be primary over the coverage provided with a trip, depending on the law and the circumstances. If you use the vehicle for professional purposes, the coverage provided with the trip may apply only in excess of your other policies.

Use of the vehicle

Use the vehicle only for lawful personal use, or professional use that does not need a commercial driver’s license, unless the listing expressly permits commercial, rideshare, or delivery use and we have approved it. You may not take the vehicle before the trip start time and must return it on time to the agreed place. Always drive safely and legally, including obeying speed limits and never driving impaired or distracted. You and your passengers must wear seat belts, and you must follow all child-seat laws. Do not leave the vehicle unlocked or the keys unsecured. If Seifly has any concern about how you are using a vehicle, we may end your trip at any time and require the vehicle’s return, including recovering it for the host.

Connected-vehicle data

Some vehicles have built-in features or a connected device that can record the state of the vehicle during a trip, such as its location, mileage, speed, fuel or battery level, tire pressure, lock status, and diagnostic and damage records (“vehicle data”). Use of those features follows the terms of the vehicle maker or technology provider. Unless the law prohibits it, you authorize the use, disclosure, and access to vehicle data for safety, trip management, and claims, and you will tell any approved driver and passengers about this section. You release the host and the providers of those features from responsibility for harm that comes from the features failing to work properly, except where the law does not allow that release.

Condition of the vehicle and add-ons

Vehicles and add-ons belong to hosts, not to Seifly. Inspect the vehicle before you drive it. If you find damage, take photos in the Seifly trip check-in at the start of the trip so you are not blamed for it later. If you find damage and do not report it, Seifly and our claims partners may assume it happened during your trip. If you believe a vehicle is not safe to drive after the check-in, do not drive it, and contact Seifly support right away.

Reviewing and approving trip check-in and check-out reports

When a host records a check-in or check-out report for your trip, Seifly asks you to review it. Open the photos and read the odometer, fuel or charge level, and any damage listed. You may approve the report or report a problem with it. When you approve, you confirm that you have reviewed the report and that, to the best of your knowledge, there is no additional damage to the vehicle beyond what the report lists. Your approval is saved with your name and the time, is kept with the trip, and Seifly, the host, and our claims partners may rely on it as evidence. Do not approve a report you have not checked. If something is missing or wrong, report a problem instead and describe it.

If you do not respond, the report still stands as the host’s record of the vehicle’s condition. Approving a report does not by itself make you responsible for damage that you did not cause, and the evidence and your protection plan terms still decide any claim.

No responsibility for shared vehicles or personal belongings

Seifly is not responsible or liable for the safety, roadworthiness, or legal status of any vehicle shared through the Services, because hosts are solely responsible for that. Neither Seifly nor hosts are responsible for belongings left in a vehicle or taken from or damaged in it during a trip.

Incident reporting

You must report any damage to the vehicle to Seifly immediately, and in any case within 24 hours of the incident. If there has been a collision, you must also report it to the police. Gather evidence from any witnesses, give Seifly or our claims partners a written description of what happened and any other information they ask for, including the identity and insurance details of anyone involved, and cooperate with any investigation. After an incident involving more than minor damage, such as a small dent or scratch, you may not keep using the vehicle unless Seifly staff give explicit permission. Failing to report an incident on time or to cooperate may reduce or cancel your protection plan.

Vehicle theft and missing vehicles

The following may lead to the vehicle being reported as stolen to law enforcement, which can expose you and any other driver to arrest and to civil or criminal penalties, and can void your protection plan:

  • You do not return the vehicle at the time and place agreed with the host or shown in your reservation.
  • You keep the vehicle past the end of the reservation without a properly approved extension through the Services.
  • You return it to a place other than the agreed return location. Damage, loss, or theft that happens before the host inspects the vehicle on return is the renter’s responsibility.
  • You misrepresent facts to the host about the booking, use, or operation of the vehicle.
  • The vehicle or its contents are stolen or damaged while it was left unlocked, running, or unattended with the keys not secured.
  • You refuse or fail to communicate in good faith with the host, police, Seifly, or other authorities about an accident or vandalism, or to cooperate with an investigation.
  • The vehicle is driven by someone who gave a false name or address or a false or invalid license, whose license became invalid during the trip, who took the keys without the host’s permission, or who withheld facts that matter to the booking.

The primary renter is responsible for reasonable costs, including private investigation and administrative costs, that Seifly considers necessary to recover a vehicle that is not returned. Seifly, an agent we hire, or the host may repossess a vehicle at the renter’s expense, without demand, if it is not returned by the end of the reservation, is found illegally parked or apparently abandoned, or is used in breach of the law or these Terms. If a vehicle you booked goes missing or is stolen during the reservation, you must immediately return the original key to the host, report it to the police as soon as you discover it and no later than 12 hours after, and cooperate fully with the host, law enforcement, and Seifly.

Specific terms for hosts

The following also applies if you share your vehicle on Seifly.

Host commitments

You promise to provide a safe, legally registered, and insured vehicle with current license plates, a clean title, and good mechanical condition. You will make the vehicle available on time, and only to a renter listed as an approved driver for the trip. Apart from what you need to check a renter’s driver’s license, you will not collect other information or documents from a renter, and you will not use renter information from the Services to gather more personal data about them, including by running background checks. Your listings must be complete and accurate, and you must honor what they say, including the quoted price. You will not force a renter to accept a more expensive vehicle or an unwanted upgrade, and you will not cancel a booking to try to get a higher price. You will only offer vehicles and add-ons that you own or have the right to share for pay, and, if the vehicle is financed or leased, you have checked that sharing it does not break your agreement with the lender. You will not list a vehicle that is the subject of a missing or stolen vehicle report, an unaddressed safety recall, or that is not street legal where it is shared, and you will not list one with illegal modifications. You will remove any firearms or other weapons from the vehicle before it goes to a renter.

Vehicle information and listing conditions

  • Vehicle eligibility. Listed vehicles must be in safe mechanical condition, free of open safety recalls, and must not exceed 200,000 miles on the odometer at the time of listing.
  • Required documents. Hosts must upload and keep current a valid title or registration, proof of insurance, and, where requested, a vehicle history report and inspection or tracking-device documentation before a listing goes live. You must give us the accurate license plate and vehicle identification number (VIN).
  • Accurate listings. Photos, descriptions, mileage, features, and pricing must accurately reflect the vehicle. Misrepresenting a vehicle can lead to removal of the listing and suspension of your account.
  • Technology in the vehicle. If your vehicle has a device or manufacturer technology that can locate it, collect data, disable it, or capture images, you must follow the law and tell renters about it in the listing.

Search results are ranked using the renter’s search details, the vehicle’s location, details, price, and delivery options, how well it matches the search, and the host’s ratings and reliability. You cannot pay for a higher ranking.

Vehicle availability

Once a trip is booked you must make the vehicle available, or deliver it, as the renter expects. If you offer pickup at a set location, you must give us the accurate location and make sure the vehicle is there when the trip begins. Before you hand over the vehicle you must check that the renter holds a current, valid driver’s license, that it matches the name on the reservation, and that the person picking up the vehicle appears to match the photo on it. If you offer remote or keyless access, you must follow our requirements for it.

Pricing, earnings, and payments

You set and can change your vehicle’s price. Seifly pays you the amount collected from renters for your vehicle, less the fees you owe Seifly under your earnings plan. Current rates are shown in the host listing flow and may vary by plan, vehicle tier, and promotions in effect at the time of booking. If you owe Seifly or a third party money, we may deduct it from your payout, charge a payment method on file, or send you an invoice.

Payouts are made through Stripe Connect. By receiving payouts you agree to the Stripe connected account terms, which may change from time to time. You authorize Seifly to share your information and transaction details with Stripe and to take the actions on your Stripe account that are needed to share your vehicle, and you must keep your information up to date with both Seifly and Stripe. Seifly and Stripe are separate companies, and Seifly is not liable if Stripe processes or holds a payment late or makes a mistake. We may change payment processors at our discretion.

Cancellations by hosts

A host who cancels a confirmed trip without a qualifying reason, such as a safety issue or a mechanical failure, may be charged a cancellation fee and lose search ranking, as described in our cancellation policy.

Airport delivery and local regulations

Some airports and cities require permits or fees for vehicle delivery or sharing, or have laws that apply to personal vehicle sharing. You are responsible for finding out which rules apply where you offer delivery or pickup and for following them.

Maintenance

You must regularly check your vehicle for defects, keep it safe, roadworthy, and in good mechanical condition, follow the manufacturer’s recommended service schedule, meet all inspection and registration requirements, and complete any recall or safety notice before the vehicle can be booked. If Seifly believes a vehicle does not meet reasonable standards, we may tell you and may remove or decline the listing until the concern is resolved. We may, but do not commit to, take steps to promote vehicle safety.

Reporting vehicle damage

If you believe a renter damaged your vehicle, you must report it through Seifly as soon as you become aware of it, and no later than 48 hours after the vehicle was returned, and you must reasonably cooperate in the investigation. Based on that investigation, Seifly or our claims partners will decide whether the damage happened during the trip and is eligible for reimbursement under an applicable plan. If you do not report in time or do not cooperate, we may decline reimbursement for that damage.

Check-in and check-out reports and guest approval

You should record a complete, accurate check-in report before each trip and a check-out report when the vehicle is returned, with photos of every required angle, the odometer, the fuel or charge level, and any damage. Seifly asks the guest to review each report you record and to approve it or report a problem. Likewise, if the guest records a report, you are asked to review it.

Guests do not always inspect a report closely, and some approve without paying close attention. A guest’s approval, or a guest’s silence, is only one piece of evidence. It does not prove that the vehicle was free of damage, does not waive any right you, Seifly, or our claims partners have to claim for damage found later, and does not limit the evidence we may consider. In the same way, a guest’s failure to approve does not make your report invalid. We decide claims on all of the evidence, and an incomplete or late report may reduce or prevent reimbursement.

You remain responsible for taking thorough photos, noting damage you see, and keeping your own records. To the extent the law allows, Seifly is not liable for a guest’s failure to review a report carefully, for a guest’s approval or non-response, or for any loss that results from relying on either.

Exclusions

  • Personal property, and add-ons or aftermarket installations such as racks, that are taken from or damaged in your vehicle during a trip. Remove all personal belongings before making the vehicle available.
  • Normal wear and tear.
  • Any trip where you broke the Agreement or gave inaccurate information about your vehicle. A plan may be voided in that case even if the violation is unrelated to the damage.

Your own insurance

You must keep valid registration and proof of insurance in any vehicle you share, and you must carry your own auto insurance that meets the minimums required by law. If the vehicle is financed or leased you may need more coverage. Keep the policy information you give us up to date. Where the law allows, you appoint Seifly as your agent to file insurance claims, receive payments, and work with law enforcement and others to recover your vehicle if needed.

Missing vehicles

If your vehicle goes missing, is not returned, or is stolen during a reservation, you must contact Seifly immediately, follow our instructions, and cooperate with Seifly and the police. If we ask you to file a police report, you must do so within 24 hours.

Specific terms for riders

These terms apply when you request or take a ride with Seifly Rides.

Requesting a ride and fares

The app shows you the price of your ride before you confirm it. The final price can change if you change the route, add stops, change the destination, or ask the driver to wait, and it can include tolls, airport fees, taxes, and our service fee. You authorize us to charge your payment method for the ride and for the extra amounts described in these Terms.

Waiting, cancellations, and no-shows

When a driver arrives, you have a short free waiting period, after which waiting time may be charged. If you cancel after a driver has accepted, or if you are not at the pickup point when the waiting period ends, a cancellation or no-show fee can apply. The amounts and timing are shown in the app before you cancel. If a driver cancels or does not arrive, you are not charged those fees.

Paying for a ride

You can pay with the methods the app offers in your area, which can include cards, Apple Pay, Cash App Pay, a bank account, the Seifly Wallet, and, where it is enabled, cash. Vouchers and promotions on your account are applied to eligible rides automatically. Gift cards and wallet balances are used as described in their own terms. You are responsible for keeping a valid payment method on your account.

How to behave in the vehicle

  • Wear a seat belt and keep to the number of passengers the vehicle tier allows.
  • No smoking or vaping, no illegal items, and no weapons, except where the law gives you the right to carry and the driver’s car rules allow it.
  • Bring pets only on a pet-friendly ride, or where the driver agrees and the law allows it.
  • Treat the driver and others with respect. Harassment, threats, discrimination, or violence can lead to the end of your access.
  • Do not damage the vehicle or leave it dirty. If a driver reports excessive mess or damage and we approve the claim after review, we may charge the cost to the payment method on your account, together with a service fee.

Safety features

Seifly Rides includes safety tools, such as PIN verification for teen trips, a locked destination once the trip starts, route and unexpected-stop monitoring, and masked calling and messaging, so your phone number is not shared with the driver. These tools help, but they do not promise that a trip will be free of risk. In an emergency, call your local emergency number first.

Family accounts and riders under 18

A person under 18 may use Seifly Rides only through a family account that a parent or legal guardian has created and linked to their own Seifly account. The guardian agrees to these Terms for the teen, is responsible for the teen’s use of the Services and for any charges, and can see the teen’s trip activity and safety alerts. A guardian can ask for a live video check-in during a trip, and the driver can see who is asking and can decline.

Lost items and complaints

Report a lost item, a problem with a ride, or a safety concern from your trip history or through support. A person on the Seifly team reviews each report. No refund or charge is decided automatically, and we may ask you and the driver for more information.

Specific terms for drivers

These terms apply to anyone who signs up to drive riders or carry deliveries with the Seifly Driver app (“drivers”).

Requirements to drive

  • You must be at least 21, hold a valid driver’s license, and be legally allowed to work in the place where you drive.
  • Your vehicle must meet the requirements for the service tier you drive for, be registered, insured as the law requires, in safe condition, and pass any inspection we ask for.
  • You must upload the documents we require, such as your license, registration, insurance, and any permits, and each must be approved by Seifly and unexpired.
  • You agree to background and driving-record checks, and to repeat checks from time to time, as the law allows.
  • You cannot go online unless all required documents are approved and unexpired. If one expires, you are taken offline automatically until it is renewed and approved.

Your relationship with Seifly

You use the Driver app as an independent provider of transportation and delivery services. You choose when to go online and which requests to accept, and you provide the driving and use your own vehicle and equipment. Nothing in these Terms makes you an employee, partner, or agent of Seifly, and Seifly does not promise you any hours, requests, or earnings. Where a separate written agreement or the law says something different for your situation, that applies.

Requests and earnings

The Driver app shows you your earnings for each request before you accept it. You will not see the rider’s total price. Your earnings can change if the rider changes the route, adds stops, or waits, and they include any fees and adjustments shown in the app. Your earnings are collected in your Seifly wallet and paid out to the payout account you connect through our payment partner, Stripe, on the schedule shown in the Driver app. You must complete the payout setup and tax details that Stripe and the law require, and you are responsible for your own taxes.

How to drive

  • Follow traffic laws and drive safely. Do not use a phone by hand while driving, and never drive under the influence of alcohol or drugs.
  • Treat riders, senders, and recipients with respect, and do not discriminate against anyone.
  • Take the route and the destination shown in the app. Do not change a destination except through the app, and expect to be asked to explain unplanned stops or detours.
  • Verify a rider’s PIN where the app asks for one, and never start a teen trip without it.
  • Keep communication inside the app. Do not give out or collect a rider’s personal details, and do not arrange payment outside the app.
  • Keep the vehicle clean, in good repair, and in line with the tier standards.
  • A guardian may ask for a live video check-in on a teen trip. You can see who is asking and you may decline.

Insurance

You must carry the insurance that the law requires for how you drive. Any coverage that Seifly or a partner provides applies only as stated in the policy or the coverage terms made available to you, and may depend on whether you are online, on the way to a rider, or on a trip.

Ratings, reviews, and access

Riders can rate you and report problems. We may review a report, ask you for your side, and, where we think it is needed for safety, quality, fraud prevention, or because required documents are missing, limit, suspend, or end your access to the Driver app.

Specific terms for deliveries

These terms apply when you send, receive, or carry a package with Seifly Delivery. They apply to senders, to recipients, and to drivers who carry deliveries.

Requesting a delivery

The sender enters the pickup and drop-off addresses and a description of the package, and the app shows the price before the sender confirms. Everything entered must be accurate. The sender is responsible for having the recipient’s permission to share the recipient’s name, phone number, and address with Seifly and with the driver for the delivery. A delivery may need a delivery code, a photo, or another proof of delivery where the app offers it.

What you may send

You may not send, and drivers may refuse to carry, any of the following:

  • illegal items, stolen goods, and anything that is not allowed to be shipped under local, state, or federal law;
  • weapons, ammunition, explosives, flammable, toxic, or other hazardous materials;
  • drugs and drug equipment, except prescription medication that is legally sent to the person it was prescribed for;
  • cash, gift cards, and other items that work like money, and items of extreme value;
  • live animals and human remains;
  • anything that is larger or heavier than the limits shown in the app, or that cannot be carried safely in the vehicle.

Seifly and drivers do not inspect packages. The sender is responsible for packing items properly and for what is inside.

Pickup, delivery, and failed deliveries

A driver will try to hand the package to the recipient or leave it as the sender instructed. If the recipient is not available or the address is wrong, the driver may wait for a short time, try again, return the package to the sender, or contact the sender, and the sender can be charged for the waiting, the extra trip, or the return. If a package cannot be delivered or returned after reasonable attempts, we may hold it for a limited time and then dispose of it as the law allows.

Drivers carrying deliveries

Drivers must handle packages with care, must not open them or use what is inside, must follow the delivery instructions, and must not leave a package without a safe handoff. The rules for drivers in the section above also apply to deliveries.

Lost or damaged packages

Report a lost, late, or damaged package in the app as soon as you can, with photos and any receipts if you have them. A person on the Seifly team reviews each report. Any compensation is decided after review and is limited to the documented value of the item and to any limit shown in the app or in the protection terms for the delivery. We are not responsible for items that were not allowed to be sent, were packed poorly, or were described wrongly.

Text messages, verification codes, and notifications

This section applies to text messages (SMS) that Opulence Corporation Inc., doing business as Seifly, sends to the mobile number on your account, for every part of the Services.

What we send

  • One-time verification codes, which we send only after you enter your mobile number and ask for a code to sign in, create an account, or confirm a sensitive action.
  • Messages about your account and your activity, such as booking, ride, delivery, payment, claim, and safety updates.
  • We do not send marketing or promotional text messages.

Your consent

When you enter your mobile number and ask for a code, or when you turn on notifications, you agree to receive these text messages from Seifly at that number, sent with automated technology. Consent to text messages is not a condition of buying anything from us. Where email or Google sign-in is offered, you can use that instead of a code by text.

Frequency, cost, and how to stop

Message frequency depends on your activity. Message and data rates may apply. You can stop text messages at any time by replying STOP, and you can reply HELP or email support@seifly.app for help. After you reply STOP we will send one message to confirm. If you stop verification codes you may not be able to sign in with your phone number. Mobile carriers are not responsible for delayed or undelivered messages.

Your number and our privacy policy

We do not share mobile numbers or text-message consent with third parties or affiliates for their marketing or promotional purposes. See our privacy policy for how we handle your information. Never share a verification code with anyone: Seifly will never ask you for it.

Dispute resolution

Please read this section carefully. It contains a mandatory arbitration provision and therefore affects your rights and governs how claims you and Seifly have against each other are resolved.

Subject to applicable law, you and Seifly agree that any dispute or claim between us that relates in any way to, or arises out of, this or earlier versions of these Terms, your use of the Services, or any breach, enforcement, or termination of the Agreement will be resolved as set out in this section.

Pre-arbitration dispute resolution

Before starting an arbitration, each of us will tell the other what the dispute is and try to settle it informally. We will contact you at the email address on your account. You can contact us at support@seifly.app with your name, phone number, email, mailing address, a short description of the dispute, and the outcome you want. If we cannot resolve it within 30 days after the notice is sent, the party that wants to arbitrate will tell the other by email before filing.

Agreement to arbitrate

You and Seifly (including its subsidiaries, employees, officers, directors, agents, insurance partners, and claims administrators) agree that any dispute, claim, or controversy that has arisen or may arise between you and Seifly, or between you and another Seifly user, will be resolved by binding arbitration, in the broadest sense of those words. That includes disputes about your use of the Services, about the Agreement and this agreement to arbitrate (including whether it is valid, enforceable, or covers a dispute, which the arbitrator and not a court decides), and about anything offered, sold, or bought through the Services such as booking, listing, or sharing a vehicle. It applies whether the claim is based on contract, statute, tort, or any other theory, and whether it arose before or after you accepted these Terms. The Federal Arbitration Act governs this agreement to arbitrate.

Exceptions

  • Disputes or claims that can be brought in small claims court.
  • Requests for an injunction or other fair relief to stop the actual or threatened infringement of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property.
  • Any claim that cannot be arbitrated under a statute or public policy. Court proceedings on such a claim will be paused until any arbitrable claims have been decided in arbitration.
  • Where California law applies, a request for public injunctive relief, meaning an injunction whose main purpose and effect is to stop unlawful acts that threaten future injury to the general public.

Arbitration procedures

Arbitration is more informal than a lawsuit. A neutral arbitrator decides instead of a judge or jury, and court review of the result is very limited. The arbitrator can award the same individual damages and relief as a court. The arbitration will be run by the American Arbitration Association (AAA) or another established provider that you and Seifly agree on, under its consumer rules for renters and its commercial rules for hosts, as modified here. Where the amount claimed is $200,000 or less, it will be decided on written submissions only, without hearings, by a single arbitrator. If a live hearing is requested or required, you or Seifly may attend by video or phone, and if a location is needed it will be in the county where you live or another place we both agree on. The arbitrator will decide the claims under applicable law, will honor legal privileges, and is not bound by decisions in other users’ arbitrations. The award is final and binding, and a court with jurisdiction may enter judgment on it. Where the law allows, communications, evidence, and rulings in the arbitration stay confidential, and settlement offers are not disclosed to the arbitrator.

Costs of arbitration

If you start the arbitration you pay the provider’s initial filing fee and, in some cases, a share of other fees set by the provider, subject to its fee waiver rules. If you win and recover the full amount you claimed, Seifly will reimburse your initial filing fee. Apart from that, each side pays its own fees and costs unless the law says otherwise.

Class and representative action waiver

You and Seifly agree that each of us may bring claims against the other only on an individual basis and not as a plaintiff or class member in any class or representative action or proceeding, whether in court or in arbitration. Unless we both agree otherwise, a court or arbitrator may not combine more than one person’s claims and may not preside over any consolidated, representative, or class proceeding. The court or arbitrator may award relief only for the individual party seeking it and only as needed to resolve that party’s own claims, and any relief cannot affect other users, subject to the exception above for public injunctive relief.

Severability

If an arbitrator or court decides that part of this agreement to arbitrate is invalid or unenforceable, the rest still applies, except that if the class and representative action waiver is found invalid or unenforceable, the whole agreement to arbitrate is void. The rest of the Agreement continues to apply.

Right to opt out of arbitration

You can opt out of this agreement to arbitrate by emailing support@seifly.app an opt-out notice within 30 days after you first accept these Terms or before your first trip on Seifly as a host or renter, whichever comes first.

Your notice must include your full name, your address, and the email addresses linked to your Seifly account. This is the only way to opt out. If you opt out, the rest of the Agreement still applies to you, including the court selection and governing law below. You do not need to opt out again when these Terms are updated.

Future changes to this agreement to arbitrate

We may update this section by posting it on this page. A change does not apply to any claim you had already filed before the change took effect, but it applies to all other disputes. If you do not agree to an updated version, you may close your account within 30 days of our notice, and any dispute will then be resolved under the version in effect when you last accepted these Terms.

Court for disputes not subject to arbitration, and governing law

If this agreement to arbitrate does not apply to you or to a particular claim, because you opted out, because an arbitrator or court so decided, or because an exception applies, you and Seifly agree that the claim will be resolved only in a state, federal, or small claims court located in San Diego County, California, and you submit to the personal jurisdiction of those courts. These Terms and the Agreement are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

General provisions

Termination

You may stop using the Services at any time. Seifly may end your access and remove your listings for any reason, or none, as far as the law allows. Ending your access does not cancel obligations you already incurred, and we may keep and continue to use information you gave us, including photos. Provisions that by their nature should survive, including payment obligations, disclaimers, limits of liability, and the dispute resolution terms, continue after termination.

No vehicle transfer or assignment

Nothing in these Terms transfers or assigns any right or interest in a vehicle or add-on shared through the Services.

Not a rental car company; no vehicle leasing

Seifly is a marketplace. It does not own a fleet of vehicles, is not in the business of renting vehicles to the public, and does not provide short- or long-term leases. Hosts and renters contract with each other for each trip, and Seifly is not a party to that agreement.

Disclaimers

Seifly provides services that enable the sharing of vehicles and add-ons between hosts and renters. Except as stated in these Terms, Seifly does not itself provide vehicle sharing, rental services, or insurance, and is not responsible for the acts or omissions of users, vehicle manufacturers, or third-party providers such as in-vehicle systems. The Services are provided “as is” and “as available”, without warranty of any kind, express or implied. To the extent the law allows, Seifly disclaims all warranties, including merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement.

Seifly does not promise that the Services, any listing, or any vehicle or add-on will meet your needs or be available on an uninterrupted, secure, or error-free basis, or that any listing, host, renter, or content is accurate, complete, or reliable. No advice or information from Seifly creates a warranty that is not stated in these Terms.

Limitation of liability and waiver

Except where prohibited by law, you waive any rights to sue or make claims against Seifly, its subsidiaries, directors, officers, agents (including claims administrators and insurance providers), and employees, and against any Seifly user, for damages or losses arising out of vehicle availability, problems with a vehicle, vehicle warranty issues, the legal or license status of a vehicle, host, or renter, third-party assessments of a vehicle’s value, or any action or inaction of a host or renter.

Neither Seifly nor anyone else involved in creating or delivering the Services will be liable for incidental, special, exemplary, or consequential damages, including lost profits, data, or goodwill, service interruption, or the cost of substitute services, arising out of the Agreement, the Services, or the inability to use them.

Except for amounts Seifly must pay to hosts or renters under these Terms, including an approved claim under a protection or earnings plan, Seifly’s total liability arising out of the Agreement or your use of the Services will not exceed the greater of (a) the amount you paid or owe for bookings as a renter, or earned as a host, in the twelve months before the event that gave rise to the liability, or (b) one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

You also waive California Civil Code §1542, or any similar law, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

These limits are an essential part of the bargain between you and Seifly. They apply to the extent the law permits, and anything found void or unenforceable will be severed while the rest stays in effect.

Indemnification

You agree to release, defend, indemnify, and hold harmless Seifly, Opulence Corporation Inc., and their subsidiaries, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, that arise out of or relate to your use of the Services, your violation of these Terms, your content, your interactions with other users, or your booking or listing of a vehicle. This includes injuries, losses, or damages that result from a booking, sharing, or use of a vehicle or add-on. It applies to the extent the law permits, and any part found unenforceable will be severed.

Rounding off; currency

Seifly may round amounts payable to or from hosts and renters up or down to the nearest whole cent or dollar, unless the law prohibits it. Amounts are shown in US dollars.

Translations

If we give you a translation of these Terms or any Policy, the English version controls if the two differ.

Severability and non-waiver

If any part of these Terms is held void or unenforceable, the rest remains in full effect. If either of us does not enforce a provision, that is not a waiver of it or of any other provision, and a waiver of one breach is not a waiver of any other breach.

General

Seifly does not appoint you or any other user as its employee, agent, or partner, and you may not make commitments on Seifly’s behalf, nor will we make commitments on yours, except as the Services or these Terms expressly provide. The Agreement is the entire understanding between you and Seifly about your use of the Services and replaces earlier spoken or written communications. You may not assign or transfer your rights or obligations to anyone without Seifly’s prior written consent, and you remain responsible for them either way. Seifly may assign these Terms in connection with a merger, acquisition, or sale of assets. Any change or waiver of the Agreement by Seifly must be in writing and approved by a Seifly officer.
